Non-requirement of custodial interrogation cannot be sole ground for grant of anticipatory bail: Supreme Court

A bench of Justices Surya Kant and JB Pardiwala said that courts should also consider whether there is a prima facie case against the accused, the nature of the offence and the severity of the punishment.

The Supreme Court recently deprecated the trend of High Courts granting anticipatory bail to accused persons on the ground that no custodial interrogation is required.
