More than prima facie case necessary to summon additional accused under Section 319 CrPC: Supreme Court

The bench added that courts should evaluate the evidence against persons sought to be summoned to adjudge if such material is sufficient to proceed against them, instead of summoning them at the very start of the trial

The Supreme Court recently observed that the power to summon additional accused under Section 319 of the Code of Criminal Procedure 1973 (CrPC) must not be exercised routinely and that the existence of more than a prima facie case is necessary to order for the same.
