Refusal to marry after sexual relations is not cheating: Bombay High Court

Given that there was no evidence to suggest that the sexual relations were not consensual, the Court held that mere refusal to marry would not constitute offence of cheating under Section 417 IPC.

The Bombay High Court recently set aside the conviction of a man who was booked for cheating a woman by having sexual relations with her under the promise of marriage (Kashinath Narayan Gharat v. State of Maharashtra).
