Bharatiya Janata Party (BJP) leader, Dr. Subramanian Swamy has moved the Supreme Court challenging a Madras High Court order that allowed a foreign trading firm, Advantage Strategic Consulting, to proceed with a defamation suit against him before the High Court of Singapore. [Dr Subramanian Swamy vs Advantage Strategic Consulting Pvt Ltd and anr].A bench of Justices Surya Kant and Dipankar Datta on Monday issued notice to Advantage Strategic Consulting in the matter.The matter will be heard after six weeks. The bench also orally asked the firm not to proceed with the defamation proceedings in the meanwhile. .The Supreme Court was hearing an appeal challenging a Madras High Court ruling passed in April this year.By way of background, the firm had registered objections to unverified references allegedly made to it by Swamy during a press conference held in New Delhi in April 2012 in connection with the 2G spectrum case.In 2014, a single-judge of the Madras High Court restrained the firm from filing a defamation suit in Singapore against Swamy. In a judgment passed on April 18 this year, a division bench of Justices SS Sundar and PB Balaji set aside this injunction order.The division bench reasoned that the Court lacked the jurisdiction to grant such an anti-suit injunction against a foreign company.The High Court, in its April ruling, added that it cannot decide whether the Singapore High Court had jurisdiction or not in the matter. This verdict has now been challenged by Swamy in an appeal filed through advocate Baani Khanna, and drawn by advocate Satya Sabharwal.Senior Advocate Vibha Datta Makhija appeared for Swamy.
