[Sudarshan TV] Madhu Kishwar seeks to intervene in "UPSC Jihad" case, says plea before Supreme Court was filed to bypass government

Madhu Purnima Kishwar has sought to intervene in the plea before the Supreme Court challenging the Sudarshan TV program titled 'Bindaas Bol', which claims the "infiltration" of Muslims into the Indian civil services..The application filed by the social activist through Advocate Ravi Sharma has relied on a report by Bar & Bench on the submissions made by the petitioners in the case..Even after stay, Sudarshan TV aired show with hate speech, caustically critical comments against SC: Petitioner in UPSC Jihad case.In his rejoinder, petitioner Advocate Firoz Iqbal Khan had referred to comments made by Kishwar and Shantanu Gupta during a Sudarshan News telecast on September 15, after the Apex Court had injuncted the channel from telecasting the remainder of the 'Bindaas Bol' episodes. The petitioner had cited this quote that Kishwar made on the show:"The Court has put a question mark on itself. They think it is their right to complete the mission of gazwa-e-hind. They consider it their right. They understand that the whole nation be converted. They want to occupy public offices by infiltrating it. They have infiltrated the education ministry from the 1st day.".In her intervention application, Kishwar has stated that her impleadment is needed so as to her "fundamental rights" are not compromised. The application states,."Applicant may not be forced to compromise her constitutional rights, be defamed, and be proscribed in a summary procedure which is completely against the procedure established by law for all persons under our Constitution."Intervention application filed by Madhu Kishwar.Kishwae further avers that the petitioner had filed a plea challenging the show on Sudarshan TV in an attempt to "bypass" the government, which is the "final authority" in determining free speech policy.."Petitioner has further chosen this petition so as to ensure that the government, which is final authority to determine Free-speech policy, and also which is also more equipped to deal with competing rights of persons by carrying out detailed investigation, is bypassed and not given a chance to take a dgcision. This act of bypassing the statutory framework itself has severely affected the rights of the Applicant."Intervention application filed by Madhu Kishwar.The application further states that the petitioner has misrepresented her quotes in the rejoinder and that the Sudarshan TV show "seeks to bring to the notice of all citizens including those secular Indians who profess Islam, the reality of various lobbies and power groups"..Kishwar goes onto state that she "deeply believes in secularism and the innate freedom of every human being to truly find her own path and purpose in life.".The Supreme Court will continue hearing the arguments in the case tomorrow. The intervenors are likely to make submissions after all main parties have concluded their arguments and rebuttals.
