[BREAKING] Supreme Court dismisses review plea against holding physical exams for Compartment, Private, Patrachar students

The Supreme Court on Wednesday dismissed the review petition filed against a June 22 judgment of the top court which had allowed the Central Board of Secondary Education (CBSE) to conduct physical/ offline exam for private, patrachar and 2nd compartment students for class 12..A Bench of Justices AM Khanwilkar and Dinesh Maheshwari passed the order stating that no case for review was made out."No case for review is made out. The review petition is accordingly dismissed," the order said. .[CBSE Class 12 Exams] Review Petition filed in Supreme Court against holding physical exams for Compartment, Private, Patrachar students .The Supreme Court had, in its June 22 judgment, accepted the assessment policy proposed by the CBSE as per which private/ patrachar/ 2nd compartment students will have to appear for offline exams.The CBSE had, however, cancelled exams for regular students and proposed an alternative assessment method for them which was approved by the Court.A petition filed by private/ patrachar/2nd compartment seeking parity with regular students was dismissed by the Court by way of its June 22 judgment.The top court had in that judgment, noted that the physical exams for these students would be held from August 15 to September 15 and results will be declared at the earliest.The review petitioners, who are private/ patrachar/2nd compartment students, stated that CBSE's scheme of evaluation makes a distinction between them and regular students.Holding physical exams for private/ patrachar/2nd compartment students while cancelling the same for regular students would amount to unequal treatment, the plea contended.."The present review being sought by the applicants will bring smile not only on the innocent faces of the students of class XII but on the faces of their parents as well as the judges of this Hon’ble Court for meeting out the grievances of the innocent school children of the abovementioned categories without delay," the review petition said..Private, Patrachar and 2nd Compartment are three distinct categories of students:I. Students who have privately pursued the prescribed course of study under proper guidance;II. Students who are unable to join a Secondary/Senior Secondary School affiliated to the Board or there are such other reasons compelling them to appear at the examinations as a private candidate.III. Physically handicapped students on producing reasonable evidence of having difficulty to attend normal institutions in the subjects not involving practical training/examination..[Read Order]
