The Supreme Court on Tuesday directed the Municipal Corporation of Delhi (MCD) to stop the unauthorized conversion of residential places into commercial complexes in Chandni Chowk [Dr. S. Jaitley & Another vs. Municipal Corporation of Delhi & Ors.]..A bench of Justice Surya Kant and Justice NK Singh warned of initiation of criminal contempt proceedings against the MCD officials for non-compliance of its directions."No further construction to convert the residential houses into commercial complexes should be allowed... We warn the municipal authorities that if any such thing is allowed to happen, it would be, besides criminal contempt of court proceedings, we will draw an inference of their collusion and connivance with builders," the Court said..The Court was hearing a petition related to certain illegal constructions in Chandni Chowk. Today, the counsel appearing for the respondents claimed that the structures were part of old construction.Justice Kant, however, took strong exception to the claim."Entire residential area has been converted into a commercial project... and you still say it is an old construction?" Justice Kant remarked.When the counsel pointed out that the petitioner was not an Indian citizen, Justice Kant said,“If she is not Indian citizen, you can do anything? Thousands of citizens are silently bearing the brunt...technical objections aren’t going to work," Justice Kant remarked.The Court also slammed the MCD authorities for their inaction."By 13th February 2025, the houses are being dismantled and constructions are being done, and you people are staying silent. Residential houses have been demolished, your blind eyes don't see," Bench lamented ..Since the report concerning the ongoing illegal constructions had not yet been submitted, the Court granted a week’s time to the MCD.The Court further directed the petitioner to propose names of eminent engineers and architects to form a Joint Inspection Committee. The details in this regard are to be submitted within two weeks."Report hasn't been submitted. In the interest of justice one weeks time is granted to do the needful. Meanwhile, the petitioner may suggest names of some eminent engineers and architects... Joint inspection committee.
