Student representations for revaluation to be decided within one week: Supreme Court accepts NIOS assurance

The Supreme Court today disposed of the plea filed by students belonging to schools under the National Institute of Open Schooling (NIOS) challenging the assessment scheme issued in July this year (Ahali Banerjee and Ors v. NIOS)..The Bench of Justices AM Khanwilkar, Dinesh Maheshwari, and Sanjiv Khanna took up this plea for hearing on Friday. The petitioners were seeking directions to the NIOS with respect to revaluation of marks..Counsel for NIOS submitted today that the Institute would assure speedy disposal of the revaluation requests made by the petitioners. .It was explained to the Court that while the petitioners sought a direction for revaluation, their cases would have to be examined by the respondent institute. The same process would have to be adopted for other similarly placed students, the NIOS highlighted. .As such, an assurance was tendered on behalf of the NIOS Chairman that should the should the students make a representation to the Institute seeking reassessment or revaluation of marks, the same would be looked into and responded to within one week of receipt of such representation..This assurance was made on the instructions of the Director (Evaluation) of NIOS, the Court recorded in its order, and accepted the same.."If representation is made, assurance is given on behalf of the Chairman, NIOS, that the same will be decided within one week from the date of its receipt and the decision taken thereon will be communicated to the concerned representationist within the same time. We accept this assurance.".Therefore, the Court disposed of this petition as well as other pending applications in the matter..The petitioner was represented by Advocate Rishi Malhotra.
