[BREAKING] Karnataka High Court order reinstating land denotification case against Chief Minister BS Yediyurappa stayed by Supreme Court

The Supreme Court on Monday stayed a March 17 order of Karnataka High Court which had reinstated a land denotification case against Karnataka Chief Minister BS Yediyurappa. .A Bench of Chief Justices SA Bobde and Justices AS Bopanna and V Ramasubramanian issued notice on a plea by Yediyurappa challenging the High Court order and proceeded to stay the same. ."It needs an interim order. Trial court will proceed with the matter," Senior Counsel KV Viswanathan, representing the Chief Minister submitted.The Court granted the request. .The case dates back to a 2011-complaint alleging that Yediyurappa and another minister Katta Subramanya Naidu misused their positions to allow the release of over 24 acres of government-acquired land in north Bengaluru to private persons, causing a loss to the State exchequer in the bargain..The release of the land involved illegal gratification, the complaint had alleged..The proceedings were earlier dropped by the sessions court in 2016 after which a plea for reinstatement of the same was filed before the High Court. .The plea for reinstatement was filed by activist Alam Pasha, the original complainant in the matter. Pasha argued before the High Court that the sessions court had wrongly dropped the case in 2016 by citing a closure report filed by the police..The Lokayukta police, following investigations, had filed a final report dropping the cases against nine persons named in the case on the ground that no evidence could be collected against them but filed a chargesheet against Yediyurappa and Naidu.Despite the police charge sheet, the sessions court went on to drop the entire case on the basis of the closure report filed against nine others in the case, it was contended by Pasha before the High Court.A single-judge Justice John Michael Cunha had accepted the same and ordered the special court to take cognizance of the offences mentioned in the chargesheet and proceed as per law.
