Vikas Dubey: "Encounter an offence against entire society", PUCL moves application in Supreme Court seeking SIT probe

People’s Union of Civil Liberties (PUCL) has filed an urgent application in a pending matter before the Supreme Court, seeking a probe monitored by a Special Investigation Team (SIT) into the encounter killing of gangster Vikas Dubey and his aides Amar Dubey and Prabhat Mishra..The application has been filed in a pending matter, filed by PUCL in May 2018. This plea sought to question the encounters that had taken place in Uttar Pradesh from January 2017 to March 2018. It had stated in detail the number of encounters and how the statements of ministers prove that they favour the practice..The urgent application seeking an SIT-monitored probe into the Vikas Dubey encounter killing has been filed by Advocate Aparna Bhat and is drafted by Senior Advocate Sanjay Parikh..The application states that “encounter is a serious crime/culpable homicide and is an "offense against the entire society.".It narrates the entire sequence of events leading to the death of Dubey and states that when he tried to flee post the road accident, he was killed by police officials..It is further noted that the police version of the encounter raises many questions, “in particular, whether they are simple administrative liquidations.”.The application cites the landmark judgment in PUCL v. Union of India, which had brought out the acts of administrative liquidations taking place in the state of Manipur. When a judicial inquiry was conducted in that case, fake encounters committed by the police were exposed..The petitioners have raised questions on the encounter of Dubey and his associates, given the pattern of encounters that have been taking place in the state since January 2017..The application also prays for a committee headed by a retired Supreme Court judge to inquire into the encounters that have been taking place in the State of Uttar Pradesh and “the Criminal Political nexus which has been prevailing in the State.”
