The Supreme Court held that if the application for interim relief was entertained by a court before the constitution of the arbitral tribunal, the bar under Section 9(3) will not apply.

Section 9(1) of Arbitration and Conciliation Act enables the parties to an arbitration agreement to approach the appropriate court for interim measures before the commencement of arbitral proceedings, during arbitral proceedings or at any time after the making of an arbitral award but before it is enforced, the Supreme Court held (Arcelor Mittal Nippon Steel vs Essar Bulk)
