YS Vivekananda Reddy murder: Appeal filed in Supreme Court against Telangana High Court order granting bail to Kadapa MP YS Avinash Reddy

Suneetha Narreddy, the daughter of former MP late YS Vivekananda Reddy, has approached the Supreme Court challenging a Telangana High Court order granting anticipatory bail to Kadapa Member of Parliament (MP) YS Avinash Reddy in connection with her father's murder..The matter was mentioned on Friday before a vacation Bench of Justices Aniruddha Bose and Rajesh Bindal for urgent listing. "They do not cooperate on summons. Then he avoids the probe on account of mothers illness. The accused is the principal conspirator in my fathers murder.. my father was killed.. High Court did not grant interim protection initially," said Senior Counsel Sidharth Luthra on behalf of the appellant."Do you want cancellation of anticipatory bail," asked Justice Bose. "High Court has gone on the basis of media reports. Please see the kind of findings," Luthra said.The bench then proceeded to list the case on June 13, Tuesday..The Telangana High Court had on May 31 granted anticipatory bail to YS Avinash Reddy in connection with the YS Vivekananda Reddy murder case.The High Court had stated that there was no direct evidence is available against the petitioner to prove his participation in larger conspiracy and the entire case rests upon hearsay evidence.Further it was observed that there was no allegation, that, at any point of time the Central Bureau of Invesitgation (CBI) claimed interference of the petitioner in the investigation, involvement in tampering of evidence or threatening of witnesses, except the allegation of destruction of scene of offence.Hence, there is no justification for a custodial interrogation of the petitioner by the CBI authorities, the High Court had held while allowing anticipatory bail.Suneetha contended that the single-judge held a mini-trial and commented on the merits of the case. Further, the accused being an MP is in a position to threaten witnesses, having already not cooperated with the probe agency..Vivekananda Reddy, a former Kadapa MP, was stabbed to death at his residence there in March 2019. In 2020, the Andhra Pradesh High Court had transferred the investigation into the murder to the CBI.The Supreme Court in November transferred the trial in the murder case to a Special CBI Court in Hyderabad. The Supreme Court had earlier taken exception to the High Court failing to decide the plea despite its orders passed by the apex court to decide the matter.It had then directed a vacation bench of the Telangana High Court to decide the plea pursuant to which it was heard and bail was granted. Further, the Supreme Court had in another order passed in April set aside a Telangana High Court order that had placed restrictions upon the CBI while interrogating Avinash Reddy.
