Mohammed Shami’s wife moves Supreme Court for transfer of domestic violence, maintenance cases to Delhi

The Supreme Court on Friday issued notice to Indian cricketer Mohammed Shami on petitions filed by his wife seeking the transfer of various matrimonial proceedings, including her maintenance plea and domestic violence complaint, from West Bengal to Delhi..The petitions filed by Hasin Jahan were listed before a Bench of Justices Manoj Misra and Manmohan. Jahan stated that she had shift to Delhi to ensure her daughter's holistic growth and development at a premium school and, thus, would be unable to attend the proceedings in West Bengal. Her plea said that without any independent source of income, she is responsible for the day-to-day care, upbringing and welfare of her daughter."Thus, under such circumstances, compelling the petitioner to contest the cases is West Bengal which is 1500 kms away from Delhi, shall cause grave prejudice and hardships to the petitioner and minor daughter," it stated.She also argued that Shami travels across countries and thus has sufficient resources and measures to contest the cases in Delhi. She further stated that his family resides in Uttar Pradesh, which is nearer to Delhi compared to Kolkata..Advocates Deepak Prakash, Sriram Parakkat and Divyangna Mallik appeared for Hasin Jahan..Shami married Jahan in April 2014 and fathered a girl child with her in July 2015. Jahan had two daughters from her previous marriage. In 2018, she accused the cricketer of domestic violence, following which a first information report (FIR) was registered against him. She then filed an application before the magistrate under the Protection of Women from Domestic Violence Act (DV Act), seeking interim maintenance of ₹10 lakh - ₹7 lakh for herself and ₹3 lakh for her daughter. The trial court ordered Shami to pay ₹1.3 lakh as monthly maintenance, which was enhanced to ₹4 lakh by the High Court in July 2025. The High Court directed that ₹1,50,000 be paid to the wife and ₹2,50,000 to the daughter till the disposal of the case relating to domestic violence against Shami..Jahan then approached the Supreme Court seeking enhancement of the maintenance amount to ₹10 lakh per month. That case is pending before the top court.
