Mumbai court grants bail to Nawab Malik in defamation complaint by BJP leader Mohit Bharatiya

A Mumbai court on Monday granted bail to Nawab Malik in a criminal defamation complaint filed by BJP leader Mohit Bharatiya..Bharatiya claimed in his complaint filed before the Metropolitan Magistrate at Mazgaon, Mumbai that while speaking at a press conference, Malik intentionally defamed Bharatiya and his brother-in-law Rishabh Sachdeva to further the agenda that "Narcotics Control Bureau (NCB) is acting under influence of BJP.".The Magistrate Court had issued notice in the complaint and directed Malik to remain present. After Malik appeared before the Magistrate, he prayed for bail considering the offences alleged against him were bailable. It was granted. .On Monday, advocate Faiz Merchant appearing for Bharatiya filed an application seeking that an order of contempt be issued against Malik for having allegedly attracted a mob outside the Court where he appeared today..The application stated that before making his appearance, Malik allegedly resorted to a campaign via social media urging political workers to flock and gather in masses and have a mass congregation near the Court..Bharatiya filed the application seeking contempt order from the Court on the following grounds:That Malik’s intent was to obstruct in the administration of justice which is apparent form his tweets. In doing so, he lowered the authority of the court.The gathering of the masses led to “interference with administration of justice” which was contempt..Bharatiya also filed a complaint with the Mumbai Police seeking registration of a First Information Report under Section 188 (disobedience to order of public servant), 269 and 270 (malignant act leading to spread of dangerous infection) of the Indian Penal Code.
