Nagpur-Mumbai Expressway: Bombay High Court strikes down exclusion of persons affected by land acquisition from market value compensation
The Maharashtra government had issued a corrigendum to avoid paying compensation at market rate to owners of the property to be acquired for the expressway as per the provisions of the Maharashtra Stamp Act.
TThe Bombay High Court recently set aside a notification of the Maharashtra government which excluded those persons affected under the Nagpur-Mumbai Express Highway Project (Maharashtra Samruddhi Mahamarg) from getting compensation against the land acquisition as per the existing market value of the property [Radhika J. Bhalerao & Ors. vs The State of Maharashtra & Ors.].
