Nationalist Congress Party (NCP) leader Nawab Malik told the Bombay High Court on Thursday that he will not make any statements against Dhyandev Wankhede, father of NCB zonal director Sameer Wankhede, and his family members till December 9, 2021. .This was after the Division Bench of Justices SJ Kathawalla and Madhav Jamdar said that either Malik has to assure the Court that he will stop making statements against Wankhede or the Court will have to pass an order to that effect..Malik's statement came in the appeal filed by Wankhede against an order of single-judge Justice Madhav Jamdar, who had refused to grant interim injunction against Malik in the defamation suit filed by Wankhede. .Senior Advocate Birendra Saraf appearing for Wankhede, argued that the single-judge even as he refused interim relief, had observed in his order that Malik's tweets against Wankhede and his family members had been made with malicious intent. He also pointed out that apart from Sameer Wankhede, none of the other family members were public officials and hence relief could not be refused. Saraf also stated that the single-judge had come to the conclusion that Malik had not reasonably verified the facts and for this reason the single-judge could not have let Malik continue with his tweets. Saraf pointed out that reading of the order would show in its entirety that there existed a strong prima facie case in favour of interim relief..The Division Bench mused as to why Nawab Malik has been tweeting documents pertaining to Wankhede and his family. "One page he is making statement, next page he is giving proof. Why is a minister acting like this? There is a forum for caste certificate validity. Anyone can go there. What is the point of the tweets? This seems to be for media publicity.. and after your son-in-law was arrested," the Bench said. .The Bench asked advocate Karl Tamboly appearing for Malik, to take instructions from Malik if he was willing to stop tweeting till the pendency of the suit. "Either he will make statement or we will restrain him," the Bench said..After taking instructions from Malik, Tamboly stated that Malik will refrain from making any statements against Wankhede and his family members till December 9, 2021 when the suit will be next listed. He also stated that Malik will be filing an appeal against the adverse observations against him by the single judge.
