NCLT Bar Association flags delay in posting of newly appointed members

The National Company Law Tribunal (NCLT) Bar Association has raised a concern over the delay in posting of recently appointed Judicial and Technical Members..As per the notification issued on January 7 by Union Ministry of Corporate Affairs, the 24 appointees will serve a tenure of five years beginning from the date they assume the charge or until they attain the age of sixty-five years.However, according to the NCLT Bar Association, the members are yet to be posted on the benches despite having completed their induction program.The bar association in a representation to the Central government on February 11 highlighted that the delay was affecting adjudication of the pending cases before various benches across India."You are aware that various cases are pending at various stages on account of lack of Members available to the many benches at places like Chandigarh, Allahabad, Bengalure, Kochi and Delhi etc. etc. In the circumstances, we at the Bar strongly feel that any delay in the notification is working adversely to the interest of various of Stakeholders, interested in the timely implementation of the provision of Insolvency and Bankruptcy Code and the Companies Act, 2013.".Out of the 24 appointees, 11 are judicial members and 13 are technical members. 21 of the 24 members have taken oath on different dates till February 12."All Members have gone through the Induction Colloquium organized by NCLT from 21.01.2025 to 30.01.2025 and are awaiting posting orders of Ministry of Corporate Affairs," as per a document available on NCLT website.24 out of 30 Courts of different NCLT Benches are functioning on half day basis due to non- availability of members.
