No separate stamp duty required for power of attorney executed with assignment deed under SARFAESI Act: Supreme Court

The Court set side a Gujarat High Court judgement which had held that stamp duty has to be independently paid for a power of attorney even if stamp duty has been paid on the assignment deed.

The Supreme Court recently clarified that separate stamp duty need not be paid towards a power of attorney document signed along with an assignment deed executed under the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest (SARFAESI) Act, 2002.
