Non-compliance with decree for restitution of conjugal rights valid ground for divorce: Karnataka High Court

Justices SR Krishna Kumar and G Basavaraja made the observation on an appeal by a man against a trial court order refusing to grant him divorce on the same ground.

The Karnataka High Court recently ruled that non compliance with a decree for restitution of conjugal rights is a valid ground for divorce under Section 13(1A)(ii) of Hindu Marriage Act [Bhimrao vs Santoshi].
