One Allahabad High Court additional judge made permanent, Two others get extension of term [Read Notifications]

The Central Government has notified the appointment of additional judge, Justice Neeraj Tiwari as a permanent judge of the Allahabad High Court.

By another notification issued the same day the Government has extended the term of additional judges, Irshad Ali and Rahul Chaturvedi  for another six months from September 22, Monday.

The notifications have been issued following two Supreme Court Collegium recommendations made on September 5.

By one resolution, the Collegium had proposed the appointment of both Justice Neeraj Tiwari and Justice Irshad Ali as permanent judges.  A second resolution passed the same day had recommended that Justice Virendra Kumar-II also be made a permanent judge. However, Friday’s notifications are silent as regards the proposed appointment of Justice Kumar as a permanent Judge.

Further, the extension of tenure of Justice Irshad Ali as Additional Judge also seems to be in contravention of the Collegium recommendation which had resolved that he be made permanent judge.

All three judges had been recommended for being made permanent judges by the High Court Collegium earlier this year; Justice Tiwari’s and Ali’s names being proposed in February and Justice Kumar’s name being proposed in April. However, the Supreme Court Collegium had deferred taking a call on these proposals in a resolution passed on July 30At the time, the Collegium had sought additional information from the Allahabad High Court Chief Justice at the time. On September 5, however, the Collegium found all three suitable for being appointed as permanent judges.

On September 5, the Collegium had also endorsed extended the term of additional judge Rahul Chaturvedi by six months, which has now been concurred with by the Government.

Justices Irshad Ali, Neeraj Tiwari, and Rahul Chaturvedi were all appointed judges of the High Court of Allahabad in September 2017.

Justice Virendra Kumar-II, in whose case the Government is yet to make a decision, was appointed an additional judge in 2016. In 2018 as well, his name was considered for being made a permanent judge. However, at the time, the Supreme Court Collegium deferred the proposal while observing that his work needs to be observed for some more timeConsequently, his term was extended by another year, which was due to end in November this year.
