Punjab and Haryana High Court protects lesbian couple facing threats from their families

The Court has direct the Punjab Police to look into the same sex couple's concerns and take necessary action to ensure that their life and liberty is not jeopardised.

The Punjab and Haryana High Court passed directions to the Punjab Police to provide security to two women in a live-in relationship facing threats from heir family members.

In an order passed on May 22, Justice HS Grewal directed the Senior Superintendent of Police to ascertain the threat perception on the complaint and take steps to ensure the women’s safety from their family members who were opposed to their relationship.

“Without commenting upon the status of live in relationship of the petitioners, the present petition is disposed of with directions to respondent No.2-Senior Superintendent of Police, Patiala, Punjab to look into the aforesaid representation qua the alleged threat perception and take necessary steps, as may be required, in accordance with law, to ensure that the life and liberty of the petitioners is not jeopardized at the hands of the private respondents,” the Court said.

The Court also relied on a Supreme Court judgment passed in 2024 where it acknowledged the social stigma faced by the LGBTQ couples and laid down guidelines for the protection of their fundamental rights and dignity.

The High Court clarified that its direction would have no effect on any civil or criminal action, which could be initiated in this matter if there is any violation of law.

Advocate Rahul Soi appeared for the women.

Additional Advocate General Parneet Singh Pandher appeared for the Punjab Police.
