Secretariat welcomes SIAC President Gary Born to discuss trends in Investment Treaty Arbitration as part of webinar series launching the firm’s Economic Damages and Valuation Practice in India with Mrinal Jain. Secretariat Managing Director Howard Rosen joins Gary in the discussion..The webinar is available for viewing on-demand https://vimeo.com/568576255 .Gary says, “India is developing rapidly, both in terms of an international arbitration destination and in terms of economic prowess and prosperity. It has been an era in which Singapore has played an increasingly important part in resolving disputes related to India. India is often the largest user of SIAC arbitrations. Indian counsels and law firms are very active in SIAC arbitration and Singapore-seated arbitrations.” Gary adds, “I think the need for expert, even-handed, enforceable dispute resolution is greater today than ever before. And that will continue to be the case. I think Secretariat's offering of an India-related practice is very timely”. .Howard notes, “When we look back 10 or 20 years, the way tribunals typically dealt with discounted cash flows was based on a rule of thumb. If there wasn't a business that employed DCF or had a history of cash flows profitably for at least five years, tribunals will say no to DCF and revert to some cost of investment, that is, return the investment with some interest calculation"..According to Mrinal, “The investment arbitration scenario has been changing rapidly all around the world. During the pandemic, the EU member states terminated several intra-EU BITs. Countries in Asia have either terminated or restricted the scope of BITs to minimum protection focusing more on dispute prevention and not dispute resolution.
