[Simarjeet Singh Bains plea] "Have you seen his attitude? State cannot be party to misuse of police:" Supreme Court

The Supreme Court on Thursday came down heavily on Punjab Member of Legislative Assembly (MLA) and Lok Insaaf Party leader Simarjeet Singh Bains, taking exception to his conduct in a rape case against him [Simarjeet Singh Bains v. State of Punjab]..The Bench headed by Chief Justice of India NV Ramana noted that after the rape case was filed against Bains, he filed numerous cases against the complainant. "Have you see the attitude of your client? He is two-time MLA and this is the way he behaves. How many cases did he file against that lady and now he wants anticipatory bail and he wants the lady to go to jail. State cannot be party to such misuse of police machinery," the Court told Senior Counsel Mukul Rohatgi who was appearing for Bains. Rohatgi, however, said that the complainant was filing false cases and was involved in running job rackets. "She is putting up false cases and she is involved in rackets running from Canada. She must face those complaints. It is not by me but by the ones who were duped of money and looking for jobs in Canada," he said.The Court, however, said that it will protect the complainant lady. It also ordered the Advocate General of Punjab to appear in the case. "We want the Advocate General to appear in this matter. File a counter in this matter," the Court told the Punjab government.The Court then proceeded to stay all proceedings against the complainant. The Court also granted interim protection to Bains for a week."We grant one week to Punjab to file a reply. Don't arrest Simarjeet Singh Bains for a week. Stay all the four cases against the complainant lady. List after one week," the Bench which also comprised Justices AS Bopanna and Hima Kohli ordered..The Court was hearing two petitions, one filed by Bains and the other by the complainant in the rape case against him. Bain was challenging a Ludhiana court order which had issued arrest warrants against Bains after he failed to appear in a case regarding violation of COVID norms, and also against rape allegations.The Punjab and Haryana High Court had declined to grant him relief after which he moved the top court. The complainant in the rape case against him also moved the Supreme Court against the cases filed against her.The Court had on Tuesday decided that it will hear both the petitions together after which they came to be listed today.
