Suo motu case on Sexual Harassment Allegations against Chief Justice of India Ranjan Gogoi listed before a new 3-judge Bench

The case initiated by Supreme Court in the wake of allegations of sexual harassment against Chief Justice of India Ranjan Gogoi, has been listed for hearing at 10.30 am today before a new Bench.

This new Bench comprises Justice Arun Mishra, Rohinton Nariman and Deepak Gupta.

When the matter was first heard on Saturday, the Bench comprised CJI Ranjan Gogoi and Justices Arun Mishra and Sanjiv Khanna.

However, when the order passed by the bench on that day was uploaded on the Supreme Court website, the name of CJI Ranjan Gogoi did not reflect in the order.

This along with the fact that CJI Ranjan Gogoi had sat on the Bench in a case which personally interested him, had led to strong objections from various quarters.

The SCAORA has expressed its reservations relating to the suo moto proceedings carried out by CJI Gogoi and has termed this “procedural impropriety.” The association, in its resolution, has also stated that the allegations ought to be dealt with as per the procedure established by the law which should be uniform for everyone. It had, therefore, called for a Full Court probe into the allegations.

Following suit, the Supreme Court Bar Association had also passed a resolution stating that the proceedings held on April 20 by the Bench comprising CJI Ranjan Gogoi and Justices Arun Mishra and Sanjiv Khanna were in violation of the principles of natural justice.

The SCBA has requested for the Full Court of the Supreme Court to take necessary steps required in this regard. The SCBA has also stated that its Executive Committee will collate all the relevant materials and facts with respect to the allegations which may be considered by the EC in its next meeting.
