Supreme Court Constitution Bench Tracker: November - December 2022

In November - December 2022, the judgments in the two cases were delivered and verdicts were reserved in three more cases.

As the year draws to a close, the Supreme Court has been consistent in its renewed and enthusiastic approach to hearing Constitution bench matters, for just over 3 months.

The last Constitution bench tracker went through the last half of former Chief Justice of India, UU Lalit's tenure which lasted only for 74 days.

On November 9, current Chief Justice of India DY Chandrachud was sworn in. CJI Chandrachud has a tenure of two years and his first month and a half at the helm of the top court may be a decent indicator as to how hearings, especially those of Constitution bench matters, would look like in the future.

Even before he was sworn in as CJI, the bench led by CJI Chandrachud declared that it would be a completely green bench with no physical papers, documents, or pleading used by the bench.

More such initiatives may be on its way especially since CJI Chandrachud has been heading the Supreme Court's e-committee for a long time.

As on December 1, 2022, 488 Constitution Bench Maters, including 54 main cases, are pending before the top court. There will be a change in this figure as we move into 2023 as verdicts have been delivered in two main five judge bench matters.

Developments in November-December 2022 in a nutshell

Benches - A total of 4 Benches were active, led by CJI DY Chandrachud, and Justices SK Kaul, S Abdul Nazeer and KM Joseph.

Cases - Verdicts were delivered in two cases by the bench led by Justice Nazeer:

Verdicts have been reserved (or remain reserved) in the following cases:

1. Challenge to the Central government's 2016 decision to demonetise the ₹500 and ₹1,000 banknotes;

2. Questions of the freedom of speech and expression of law makers;

3. Challenge to current system of appointments to Election Commission of India;

4.Challenge to validity of All India Bar Exam;

5. Extent of Supreme Court's power under Article 142 to grant a divorce decree;

6. Retrospective application of immunity against arrest;

Verdicts also remain reserved on the question of whether the case regarding the Bohra community's right to excommunicate dissidents, needs to be referred to a nine-judge bench.

Since Justice Nazeer is set to retire from office on January 4, 2023, the judgments reserved by the bench led by him will likely be delivered by then.
