Supreme Court grants singer Neha Singh Rathore anticipatory bail in case over tweets on PM Modi

The Supreme Court on Tuesday granted anticipatory bail to Bhojpuri singer and activist Neha Singh Rathore, booked in a criminal case for her social media posts on Prime Minister Narendra Modi, the Bihar elections and Hindu-Muslim politics [Neha Singh Rathore @ Neha Kumari Versus State of Uttar Pradesh and Ors.]

A bench of Justices JK Maheshwari and AS Chandurkar made absolute the interim protection earlier granted to Rathore.

The case stems from a first information report (FIR) filed in Lucknow last year after Rathore’s social media posts following the Pahalgam terror attack. 

In those posts, she alleged that PM Modi visited Bihar and threatened Pakistan in order to win votes in the name of nationalism. She also wrote that the Bharatiya Janata Party (BJP) sought to polarise voters using Hindu-Muslim and India-Pakistan issues.

Rathore first moved the Allahabad High Court and then the Supreme Court seeking to quash the FIR but both courts rejected her plea.

She then moved the Allahabad High Court again, this time seeking anticipatory bail.

On December 6, 2025 the High Court denied her relief, noting that the tweets in question were made at a crucial time after the terror attack and had referred to the Prime Minister in a “disrespectful" manner.  It also rejected arguments that Rathore had merely expressed her freedom of speech.

Rathore challenged this order before the Supreme Court.

On January 7, the top court issued notice in her plea for anticipatory bail and granted her interim protection for the time being.

It was this interim protection that was made absolute today.
