It looks like the Siwan Jail will be a jailbird short soon..The Supreme Court today directed that Bihar politician Mohammed Shahabuddin be transferred from Siwan Jail to Tihar Jail, Delhi one week hence..The judgment was passed by a Bench of Justices Dipak Misra and Amitava Roy in two petitions – one filed by Asha Ranjan, wife of slain journalist Rajdeo Ranjan and the other by Chandrakeshwar Prasad whose three sons were allegedly murdered by Shahabuddin..Asha Ranjan had prayed for transfer of the murder case of her husband from Siwan to Delhi, on the ground that the trial in Siwan would be manipulated by Shahabuddin..Senior Advocate Dushyant Dave and Advocate Kislay Pandey appeared for Asha Ranjan while advocate Prashant Bhushan appeared for Chandrakeshwar Prasad. Senior Advocate Shekhar Naphade has been defending Shahabuddin..In the judgment delivered today, the Bench also accepted advocate Prashant Bhushan’s argument to conduct Shahabuddin’s trial by video conference, even as it.The Court exercised its powers under Article 142 and noted that the accused could not be allowed to jettison the ‘fundamentals’ of criminal trial under the guise of fair trial..It also directed that no special treatment would be given to Shahabuddin, and he would be required to be transferred to Tihar jail within one week from now..The case is now listed for March 21, when the court will hear the plea of the petitioner alleging that despite having named Shahabuddin as a key conspirator in her husband’s murder, the police in Siwan had refused to file an FIR against him..Read the judgment below..Image taken from here.
