Supreme Court orders Centre to form panel to ensure State-wise uniformity in facilities for retired HC judges

The Supreme Court on Monday directed the Central government to constitute a committee to frame uniform guidelines for providing various facilities to retired High Court judges in India.

A Bench of Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and V Mohana said that there was a lack of uniformity in facilities being provided to the judges in India.

While some provide everything that is needed, some States do nothing for the judges, CJI Kant remarked. Accordingly, the Court stressed on the need for a uniform policy.

Considering that the Union government also releases funds for the purpose, the Court ordered that a committee for uniform guidelines be constituted by the government within two weeks.

"There can indeed be no doubt that these facilities must be ensured on a uniform basis, as there is no reason whatsoever for such amenities to vary from State to State. Keeping this perspective in mind, we have impressed upon the Union of India to constitute a committee to lay down uniform guidelines and also the manner and mechanism for financial assistance," the Bench said.

It added that the committee shall submit its recommendations to the Union government and also place the same before the Court within three months from the date of its constitution.

Commenting on the security needs of retired judges, Justice Bagchi said,

"Security of one police officer for five years is reasonable for a High Court judge...because they deal with sensitive issues also."

CJI Kant highlighted the payment of low amounts for secretarial, security and other facilities.

"See the clause - ₹15,000 for secretarial services, security, travel etc."

The Court will hear the matter after three months.
