The Supreme Court of India recently quashed a case filed by a woman who accused her husband and his family members of misleading her into marrying him [Rohan & Ors v The State of Gujarat & Ors]..A Bench of Justices Sudhanshu Dhulia and K Vinod Chandra noted that even though the woman claimed that her husband lied about being an eye surgeon and having a skin disease, there was nothing to show that she was deceived. The Court observed that WhatsApp chats between the woman and her husband revealed that there was no effort on his part to disguise or befool her about his skin disease or regarding his qualifications. “From all reasonable assumptions as well as the documents which have been placed before us, it is clear that the complainant had full knowledge that the appellant was suffering from skin disease and he was not an Eye Surgeon but an Optometrist,” the Bench observed. Therefore, the Court quashed the First Information Report (FIR) filed by the woman. .The Bench passed the order on a plea filed by one Rohan and his family members challenging the decision of the Gujarat High Court rejecting his plea. His wife had complained to the police just a few months after their marriage in April 2023.She claimed that she had been misled into marrying him, believing he was an eye surgeon, only to later discover he was an optometrist and suffered from leukoderma, a visible skin condition..However, the top court found no evidence of deception and declared that the FIR was an abuse of the legal process.
