Supreme Court refuses to entertain Dayanidhi Maran, subsequently recalls its order; Aryama Sundaram, ASG Pinky Anand appear

In a strange turn of events, the Supreme Court today recalled its order refusing to entertain the petitions of former Telecom Minister Dayanidhi Maran and his brother Kalanithi Maran (Petitioners) to quash the summons issued by the Special Court hearing the cases related to 2G scam..The order was recalled by a Bench comprising Justice V Gopala Gowda and Justice R Banumathi a couple of hours after they had refused to entertain the petitions and allowed the Petitioners to withdraw their petition..According to The Hindu, the Court took this step after Additional Solicitor General (ASG) Pinky Anand mentioned the matter just before the Bench rose and told the Court that the matter should have been heard by the Bench hearing the 2G scam and not any other Bench. Anand submitted that there is a specific order of the Supreme Court that any matter arising out of the 2G spectrum case has to be heard by the Special Bench which is hearing the matter..The Court proceeded to record the submissions of the ASG and posted the matter before the Special Bench presided by Chief Justice HL Dattu for February 9..Earlier in the day, the Bench headed by Justice Gowda had refused to entertain the petitions which had been filed challenging the summons issued by the Special Court in the case pertaining to Aircel-Maxis deal..Senior Advocate Aryama Sundaram, who appeared for Maran, had submitted that the case was totally unrelated to the 2G spectrum scam and no licenses were allotted during Maran’s tenure as Telecom Minister..The Court had, however, declined to entertain the plea and directed the Petitioners to approach the High Court under Article 226 while allowing them to withdraw the petitions.
