The Supreme Court on Monday issued notice to comedian Samay Raina and four other comedians for their alleged insensitive remarks against personal with disability..The Bench of Justice Surya Kant and Justice N Kotiswar Singh asked the Commissioner of Police of Mumbai to ensure the presence of Raina, Vipul Goyal, Balraj Paramjeet Singh Ghai, Sonali Thakar aka Sonali Aditya Desai and Nishant Jagdsish Tanwar in Court on the next date of hearing."Commissioner of Police, Mumbai, is directed to serve notices on respondent no. 6-10 to ensure their presence in court on the next date of hearing, failing which coercive steps will be taken to secure their presence," the Court ordered.The order was passed in the case moved by Cure SMA India Foundation accusing Raina of insensitive remarks over the high-cost treatment for Spinal Muscular Atrophy. He is also alleged to have ridiculed a person with disability.The petition said there should be regulations for the broadcast of such online content which violates the right to life and dignity of persons with disabilities. Today, the Court impleaded the State of Maharashtra as a party to the case and issued notice to the Union of India and other bodies, including the News Broadcasters and Digital Association and the Indian Broadcasting and Digital Foundation."Having regard to the sensitivity and importance of the issue by the petitioner-foundation, we request the Ld. Attorney General for India to assist in the matter," the Court ordered..The Court, while addressing the petitioner's counsel, asked for suggestions on remedial and punitive actions against such persons who make insensitive remarks against persons with disability."It is a breach of express provisions," it remarked.The Court also said such remarks have a damaging effect on social, legislative measures being taken to uplift and integrate the differently-abled."Any speech which is meant to demean another community ... if there is such kind of liberty, we will curtail it," it added..Senior Advocate Aparajita Singh appeared for the petitioner organisation.The plea was drawn by Advocate Pragya Barsaiyan and Suprateek Neogi.
