Tajinder Bagga arrest: Punjab files Habeas Corpus plea in Punjab and Haryana HC alleging detention of police personnel by Haryana

The State of Punjab has filed a Habeas Corpus petition before the Punjab and Haryana High Court against Haryana government alleging that 12 Punjab Police personnel, who were involved in the arrest of Bharatiya Janata Party (BJP) leader Tajinder Bagga, have been detained by Haryana Police in Kurukshetra. .The matter was listed before Justice Lalit Batra who issued notice to Haryana and Central governments and posted the case for further hearing on Saturday. The Punjab police personnel who had come to Delhi and arrested BJP leader Tajinder Bagga were taken into custody by Haryana Police while they were on their way to Mohali with Bagga. The Haryana Police had acted based on Delhi Police registering a case after Bagga's father had filed a complaint of abduction of his son. .The Punjab Police team was stopped on highway at Kurukshetra by Haryana Police and taken to a police station.Bagga was later handed over to Delhi Police. Advocate General (AG) for Punjab, Anmol Rattan Sidhu submitted that twelve Punjab Police officials have been illegally detained and should be released immediately. He further submitted that the Deputy Superintendent of Police (DSP) Kuljinder Singh had gone to Police Station Janakpuri in Delhi, to intimate the arrest of accused Tajinder Pal Singh Bagga, with a view to get the DDR lodged but to no avail. Instead, he was illegally detained by the Delhi Police officials, the AG submitted.In view of that, he also contended that the custody of Tajinder Pal Singh Bagga should be restored to the Punjab Police..Advocate General of Haryana BR Mahajan contended that the Punjab police team was intercepted after receipt of a message from Delhi Police in respect of kidnapped person (Bagga). Further, after Bagga and police personnel were brought to the police station, a team from Delhi Police had arrived and identified Bagga.They also produced search warrants issued by Neetika Kapoor, Metropolitan Magistrate-11 of Delhi's Dwarka District Courts for production of Bagga in the said court, it was pointed out.He further contended that in terms of deliberations made by Delhi Police and Punjab Police and further in pursuant to search warrant issued by Delhi Court, custody of Tajinder Pal Singh Bagga was handed over to the Delhi Police. Pertinently, the Haryana AG said that no Punjab police official has been detained by Haryana Police as alleged. Instead, they on their own volition were sitting in Police Station Sadar, Kurukshetra, though they have been requested to proceed to their destination as no further action was required in the matter.Additional Solicitor General of India Satya Pal Jain too maintained that no Punjab Police official has been detained by Delhi Police at Janakpuri as alleged.
