Wife's impotency allegation against husband in matrimonial case not defamatory: Bombay High Court
The Court held that the wife cannot be prosecuted for defamation for making such an allegation in her pleadings in the matrimonial case against her husband.
The Bombay High Court recently observed that allegations of impotency made by a wife against her husband in litigation arising out of matrimonial disputes are justified and do not amount to defamation [P v VIG].
