The Supreme Court today suggested to The Wire and Jay Shah to resolve the civil defamation case between them.
A Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud made this suggestion to Senior Counsel Neeraj Kishan Kaul and advocate Nithya Ramakrishnan.
The Court had made a similar suggestion even in the criminal defamation case which was heard last on April 18.
When the matter came up for hearing today, Justice Chandrachud asked the parties to resolve the dispute.
Nithya Ramakrishnan then told the Court that Jay Shah was asking for an apology but “there is no question of apology”.
She then told that they are willing to carry any clarification that Jay Shah wants them to.
“They are willing to carry any clarification you want. That is as fair as it can be”, remarked Justice Chandrachud.
“I will take instruction on this”, said Neeraj Kishan Kaul appearing for Jay Shah.
Kaul, however, also expressed his disapproval at the slant of the article and the innuendos.
Chandrachud J. said that “you are in public life. You should be ready for such […].”
“But I am not in public life”, was Kaul’s response.
The Court then adjourned the matter for July 9, the same day when criminal defamation case will also be taken up.
