The Court found that an SDM had acted in violation of the law by sending the man to jail for around three days instead of following certain procedures laid down in the CrPC.
This matter needs to be placed before the Hon'ble Administrative Judge of the concerned district for information and necessary action, the Court said in the order.
The Court also reiterated that objections under Section 47, CPC cannot be raised at the stage of executing or enforcing an arbitral award under Section 36 of the Arbitration Act.
