A Delhi court on Thursday directed that Delhi Police should not take any coercive action against Congress Member of Parliament (MP) and Jawaharlal Nehru University (JNU) professor A Bimol Akoijam in connection with the sexual harassment case against him.
Several students have levelled allegations of sexual harassment against Akoijam, pursuant to which the Delhi Police registered a first information report (FIR) for offences of sexual harassment under Section 75 of the Bharatiya Nyaya Sanhita (BNS).
Special Judge Digvinay Singh of the Rouse Avenue Courts said that seven days' notice must be given to Akoijam if his arrest is required.
The court noted that Akoijam has clear antecedents and that he has been cooperating in the investigation. It added that the investigation is ongoing and victims' statements have yet to be recorded because the JNU administration has not provided their names and details.
Further, Judge Singh said that in case of non-cooperation in the probe, Delhi Police is at liberty to approach the court for necessary directions.
Akoijam's counsel told the Court today that he had joined the probe and has been cooperating.
Meanwhile, the public prosecutor informed the judge that notice was issued to JNU to provide information and details of complainants against Akoijam and that police will speak to them.
Earlier, Akoijam was dismissed from JNU with immediate effect on October 9, following an inquiry into allegations of sexual harassment.
However, On November 2, the Delhi High Court stayed his termination from service after Akoijam challenged the university's action.
Akoijam has denied the allegations levelled against him. He has maintained that the allegations are politically motivated.
The Congress MP had been associated with JNU’s Centre for the Study of Social Systems under the School of Social Sciences.
