The Punjab and Haryana High Court has cancelled the bail granted to a murder accused after he sent various threatening messages to the complainant and his family, including one saying "band baja dunga" [Sourabh Narula v State of Haryana & Anr]
Justice Vikram Aggarwal said the accused cannot be permitted to remain on bail because any untoward incident can take place if he is allowed to remain free.
"In the considered opinion of this Court, he has violated the most essential condition of the order granting bail by threatening the complainant side," the Court said.
The accused Suresh alias Binni Sardana is accused of having committed the murder of one Shyam Lal, who was the servant of one Mukul, a cousin of the complainant Sourabh Narula.
Suresh was granted bail on January 28 by the High Court in the case dating back to June 24, 2023. However, soon after he came out of the prison, the accused allegedly started threatening the accused.
Narula then moved the Court. In his petition, the complainant said that he and his father received threatening messages on Instagram and Facebook from the accused.
One message to the complainant's sister was flagged in particular.
“Band bja dunga iske chakkar me to sabki,” the message said.
It could mean that "I will finish all of you because of this".
It was also alleged that the accused threatened the brother of accused in person. The accused is also alleged to have threatened the accused that if he deposed against him before the trial court, he would upload photographs of his sister on social media.
The Court was told that a separate FIR was registered in this regard and the accused is now in custody in that case.
In response to the petition, the accused appeared before the Court through video conference, but his behaviour was found to be "abnormal and speech incoherent."
The Court said the jail authorities should get his mental state examined, if so required. Considering the nature of allegations against him, the Court cancelled his bail.
