Bar Council of Kerala issues suo motu show cause notice to advocate BA Aloor for professional misconduct

The Bar Council of Kerala (BCK) has initiated a suo-motu case against advocate BA Aloor and his associates for violation of Standards of Professional Conduct and Etiquette during the court proceedings in a recent gang rape case in Kochi..In a show cause notice dated November 25, 2022 sent to Aloor and his five associate lawyers, the BCK said that it came to know through various media reports that Aloor violated the Bar Council of India Rules by creating dramatic scenes in the court by appearing without a vakalat or even without the authorization of the accused and obstructed court proceedings by creating a scene in front of judges, public and advocates. “Please note that Rule 36 sets out wholesome rules of professional misconduct. By your such act and conduct, you have blemished the dignity of the noble profession,” the show cause notice said.The BCK, therefore, sought an explanation from Aloor within two weeks as to why disciplinary proceedings should not be taken against him for professional and other misconduct.Apart from Aloor, the other lawyers to whom the notice has been issued are Prasanth KP, Anuraj S, Krishnenthu Suresh, Vishnu Dileep and Mohammed Ameer..Bar & Bench reached out to Aloor who had the following to say: "I am very grateful to you because no one is trying to know my response. Everyone is writing whatever they want. They were saying, I was waiting for the vakalat but I had already filed the vakalat. The other lawyer was waiting to get the vakalat at the last minute before production of one of the accused before the court. This is the real fact. This is known to the media but someone is trying to tarnish me. I will reply to the notice of Bar Council of Kerala as soon as possible as they are going forward without knowing the real fact. The Court has not directed the other lawyer to bring NOC since everything is on record. Suo motu case they have taken for indecent behavior in the court. I have 24 years of experience. When a junior advocate threatens me inside the court, what else am I expected to say other than - 'you should go outside otherwise I will prosecute you'."
