BCI resolves to enquire into Patiala House violence, submits affidavit in Supreme Court

The Bar Council of India (BCI) has resolved to enquire into the violence that erupted in Patiala House court complex..The BCI has filed an affidavit in the PIL filed by JNU Alumnus ND Jayaprakash setting out the contents of the resolution. The resolution, however, states that it is subject to the order of the Supreme Court, which is already seized of the matter..Below are excerpts from the resolution:.“Hon’ble members have said that any true citizen or lawyer of India is supposed to strongly react to slogans like Pakistan Zindabad, Hindustan Murdabad, India go back, Pakistan long live etc..Such acts of anybody always deserve to be strongly condemned and need to be opposed strongly; But in decent and can be done legal ways and not by indecent methods like the alleged incident….Whatever might be the background or reason, the class of advocates is not supposed to indulge in the incidents of abusing or committing any untoward occurrence in the court premises or anywhere, that too in robes. All the members are unanimous on this point that hose who are supposed to protect the law and savers of law are not expected to take law in their own hands..The council accordingly resolves to proceed with the enquiry… If the Hon’ble apex court allows the Council to proceed with the enquiry, only then the resolution of the council will stand ratified, otherwise it is subject to the final order of the Hon’ble apex court dealing with this incident..”.The Committee constituted to conduct the enquiry consists of BCI Vice-Chairman, Senior Advocate MN Krishnamani and a retired judge of the Patna High Court..The Supreme Court today did not pass any order on the stand of the BCI. It has taken on record the reports filed by the Delhi High Court, the Delhi Police and the team of lawyers who visited the Patiala House court. The same will be supplied to all parties.
