Centre notifies transfer of Justices Biswanath Somadder, Vivek Agarwal to Allahabad High Court

The Central Government has notified the transfer of Justice Biswanath Somadder, Judge of the Calcutta High Court and Justice Vivek Agarwal, Judge of the Madhya Pradesh High Court, as Judges of the Allahabad High Court.

As per the Central Government Notification dated October 3, Justices Somadder and Agarwal are directed to assume charge of the office in the Allahabad High Court on or before October 17, 2019.

The Collegium had first resolved to transfer Justice Vivek Agarwal to Allahabad High Court on August 28. Justice Agarwal had thereafter requested that the move be reconsidered.

In a resolution passed on September 3, the Collegium, however, refused to accede to the request and reiterated its recommendation to transfer Justice Vivek Agarwal from the Madhya Pradesh High Court to the Allahabad High Court.

Justice Vivek Agarwal was appointed as an additional judge of the Madhya Pradesh High Court in April 2016, and was made a permanent judge in March 2018.

The Collegium had resolved to recommend the transfer of Justice Biswanath Somadder to the Allahabad High Court on August 28.

After obtaining his law degree from the University of Calcutta, Justice Somadder enrolled as an Advocate in July 1989. His areas of practice included arbitration, company law, revenue law, civil and criminal matters. He was elevated to the High Court Bench as a permanent judge in June 2006.
