Delhi High Court constitutes committee under ex-CJI Sanjiv Khanna to oversee Greenopolis homebuyers’ claims

The Delhi High Court on Tuesday appointed a monitoring committee headed by former Chief Justice of India (CJI) Sanjiv Khanna to oversee and streamline the claims of hundreds of homebuyers affected by the stalled Greenopolis housing project in Gurugram [Directorate of Enforcement v Greenopolis Welfare Confederation and Anr].

Former Delhi Higher Judicial Service (DHJS) officers HS Sharma and Ajay Kumar Kuhar will assist Justice Khanna in the committee. Justice Khanna has offered to work pro bono.

In a detailed order, Justice Anup Jairam Bhambhani said that the committee will verify genuine homebuyers, assess competing claims over properties attached by the Enforcement Directorate (ED) and facilitate restitution to eligible claimants.

It asked the Justice Khanna committee to endeavour to complete its work within eight months of its first meeting and submit reports every three months. 

The Court passed the order while dealing with petitions by the ED, Greenopolis Welfare Association (GWA) and Greenopolis Welfare Confederation (GWC) challenging the November 27, 2025 PMLA Court order.

The dispute concerns the Greenopolis project in Gurugram, developed by Three C Shelters and Orris Infrastructure. Of 1,862 units, 1,650 had been allotted before abandonment. Three C Shelters allegedly collected ₹776.60 crore and Orris collected ₹383.06 crore from homebuyers. The ED argued that ₹214.09 crore was siphoned off to related entities.

In its order, the Special Court had ordered restoration and disposal of ED-attached properties. The ED challenged this, citing improper identification of beneficiaries and non-compliance with the statutory framework.

After considering the case, the High Court noted that there were several complexities in the case. Therefore, it constituted the monitoring committee.

The Court clarified that the committee's proceedings would not interfere with the ongoing corporate insolvency resolution process (CIRP) under the Insolvency and Bankruptcy Code (IBC) or affect homebuyers' rights in those proceedings.

Panel Counsel Vivek Gurnani along with advocates Kanishk Maurya and CH Abhinandan Patra appeared for the ED.

Senior Advocate Ramji Srinivasan with advocates Tanmaya Mehta, Harshit Sethi, Shilpa Ohri, Jai Sikand and Khushboo Nahar represented Greenopolis Welfare Confederation.

Senior Advocate Mahesh Jethmalani with advocates Kanika Singhal, Shivam Singh Rana and Deepshikha represented the IRP.

Senior Advocate Krishnan Venugopal with advocates Pooja Mahajan, Savar Mahajan, Srivastava Reddy and Urvashi Girdhar represented GWA.
