Delhi High Court grants protection to live-in couple who left their spouses

The Delhi High Court has granted police protection to a couple in a live-in relationship who had left their spouses and were receiving threats from the woman’s family. 

Justice Saurabh Banerjee observed that the petitioners, as citizens, are entitled to protection of their fundamental rights under Articles 19 and 21, including the right to life and personal liberty.

He emphasised that whether the couple is married or in a live-in relationship is not a relevant consideration in such cases.

“Since the petitioners are both Indian national citizens, they are well and truly entitled to the protection as available to them in the form of the guarantees and fundamental right(s), enshrined under Article(s) 19 and 21 of the Constitution. For this, the status of the citizens, whether they are (un)married or are in a Live-In relationship, is not a germane factor for consideration whence this Court is dealing with the present proceedings,” the Court said. 

According to the petition, the woman had faced humiliation and torture from her husband since 2016. She later began living with the co-petitioner in Hyderabad in February 2026. The couple claimed they were subjected to threats and intimidation from the woman’s husband and relatives, forcing them to relocate to Delhi in March.

The petitioners told the court they were consenting adults who had chosen to live together despite being married to other partners.

They further alleged that family members were attempting to track their whereabouts. They also said that despite submitting representations to authorities, no action was taken. 

During the hearing, the Delhi Police said that adequate protection will be provided to the couple. 

After considering the case, the High Court allowed the couple’s petition and directed local police officials to provide protection as needed. It also asked the couple to inform authorities if they relocate, ensuring continued security.
