The Delhi High Court on Saturday refused to entertain a public interest litigation (PIL) petition seeking seamless pedestrian footpaths from the area near Nizamuddin Dargah up to the Delhi Golf Club [Legal Attorneys and Barristers Law Firm vs State]..A Bench of Acting Chief Justice (ACJ) Manmohan and Justice Manmeet Pritam Singh Arora remarked that it cannot delve into deciding the design of flyovers and walkways, which is in the government's domain."Do you stay in Delhi or not? We have walked there so many times, where is the problem? Sorry. This is absolutely misconceived. We cannot decide where flyovers should be. We cannot do anything about the design of Delhi roads. There is no space means no space. You go speak to your local MLA. What can we do?!" the ACJ remarked..Appearing for the petitioner, advocate SN Jha told the Court today that representations had already been sent to the government on the matter."The rights of pedestrians are being trampled. The (Sunder Burj) roundabout and flyover is there in between which is only convenient for cars. There was footpath earlier but now there is a wall. I only need back the earlier footpath below the Oberoi flyover," he argued.The High Court, however, refused to budge and said the issue is not for the court to resolve. The Bench eventually allowed the petitioner to withdraw the PIL, with liberty to approach concerned government authorities..Notably, the Court was sitting today despite it being the weekend to make up for working hours lost on account of farewell functions held this week to bid adieu to three judges. While one of these judges had retired, the other two judges were transferred to other High Courts.
