Delhi High Court restrains Vivek Bindra from claiming association with Dr. Lal PathLabs founder

The Delhi High Court recently restrained motivational speaker Vivek Bindra and his company Bada Business from claiming that Dr. Lal PathLabs founder Dr. Arvind LaL is connected with Bindra's business in any manner [Dr Arvind Lal v Bada Business Pvt Ltd & Ors]..In an order passed on May 20, Justice Anup Jairam Bhambhani ordered Bindra and Bada Business to cease and desist from using the name, photograph or likeness of Dr. Lal in connection with their business in any manner whatsoever.“The defendants are also directed to forthwith delete and take-down all advertisements /promotional material/statements/brochures etc., whether in writing or in pictorial form, from their website and from all their social media handles that claim or suggest any connection between the plaintiff and any of the defendants in any manner whatsoever. Let the needful be done within 01 week,” the Court ordered. .The Court passed the ex parte interim order while dealing with a suit filed by Dr. Arvind Lal against Bindra seeking a declaration that he (Lal) has no privity of contract with Bindra or his company..Dr. Lal stated that the defendants are using his name, likeness, and personage to promote their business under the name and style of ‘Bada Business - An Initiative by Dr Vivek Bindra’, They are representing to the public-at-large that Dr Lal is one of the ‘Bada Business Professors’ who will take lessons and deliver lectures for the one-year Diploma course in entrepreneurship to be conducted by Bada Business under the aegis of GLA University in Mathura, it was claimed.The plaintiff said that his name has been canvassed as one of the ‘Professors of Billionaire Blueprint’, and his case study has been cited as an example by the defendants. The business course was being sold at the price of ₹49,000 plus GST and Dr Lal’s name was stated to be included in the Bada Business Professor List for 2023.Dr Lal told the Court that he had participated in only one webinar hosted by Bada Business on an invitation where he addressed some students of GLA University but after that, he has not been engaged in any manner with the defendants’ business..The Court considered the case and passed the injunction order..Advocates Mumtaz Bhalla and Tabish Samdani appeared for Dr Arvind Lal.None appeared for the defendants..[Read Order]
