Expedite process to fill RERA vacancies: Delhi High Court directs Delhi government

The Delhi High Court on Wednesday directed the Delhi government to expedite the process of filling vacancies in Delhi's Real Estate Regulatory Authority (RERA).

A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia directed the government to file an affidavit regarding the appointments in two weeks.

"We direct that the process of filling up the posts be expedited...File an affidavit in two weeks...See to it that at least the judicial members are appointed," the Court said.

The Bench passed the order after two advocates - Aishwary Jain and Deeptanshu Jain - approached the High Court seeking a direction permitting outgoing Delhi RERA Chairperson Anand Kumar to continue in office on an interim, stop-gap basis until a successor is appointed.

It was stated that the Chairperson's post fell vacant on August 11, 2026, after Kumar turned 65, while a member's post has been vacant since December 2025. The petitioners allege that no reference has been made to the Selection Committee under Rule 17 of the Delhi RERA Rules, 2016, making it impossible to meet the 90-day selection timeline mandated under Section 24(3) of the RERA Act.

Senior Advocate Sanjeev Sagar appeared for the petitioners and argued that RERA must consist of a Chairperson, a judicial member and a technical member, but the Chairperson and judicial member have demitted office, leaving only a technical member.

Counsel appearing for the Delhi government informed the Bench that the proposal to extend the tenure of the outgoing chairperson had been rejected on August 11 and the process to appoint a new chairperson was underway. Further, the counsel said that the selection process for filling the post of the judicial member is complete and the government is awaiting the selection committee’s recommendation.
