An angry Justice Rohinton Nariman today warned Advocate Mathews Nedumpara of initiating contempt proceedings against him if he is not careful while arguing.
Justice Nariman came down heavily upon Nedumpara for referring to Senior Advocate Fali Nariman while hearing a case for automatic senior designation upon lawyers who have attained the age above 62 years and who have had an active practice of over 30 years.
Justice Nariman, who was on the Bench with Justice Vineet Saran warned Nedumpara to be careful what he says, observing.
“It’s our great misfortune that we hear people like you. Be very careful in what you say, we are warning you… Be very careful, after that we will issue Contempt…
Why did you take Mr. Nariman’s name? What has Fali Nariman got to do with this case? We will take contempt action against you.”
Nedumpara, in an attempt to placate the Court said that he, in fact, did not take Mr. Fali Nariman’s name, at which point Justice Rohinton Nariman said,
“The whole courtroom heard you take his name, they’ll file affidavits.”
“Your Lordships have immense power. You can send me to Tihar jail. It is close by.“
Justice Nariman then said that,
“You think you can get away by saying whatever you want, to whomsoever you choose and none of us will take any action against you? You took his name, that is bad enough… What has he got to do with this matter, you tell us.“
Nedumpara after a brief pause went on to argue his case, while Justice Nariman directed the Court master to take down Nedumpara’s arguments verbatim.
After hearing the submissions made by Nedumpara, the Court reserved its order in the case.
