Kerala High Court allows couple above statutory age bar to continue with Assisted Reproductive procedure despite bar under ART Act

The Kerala High Court recently granted a married couple aged over 50 years to continue their treatment with Assisted Reproduction Technology although, under the Reproductive Technology (Regulation) Act (ART Act) the upper age limit for assisted reproductive treatment for men is 55 years and for women is 50 years [Jomon CV & Anr. v The Union of India & Ors.].
