Anil Deshmukh Document leak case: Delhi High Court notice to CBI in bail plea by lawyer Anand Daga

The Delhi High Court on Friday sought the response of the Central Bureau of Investigation on a bail application by Mumbai lawyer Anand Daga who has been held in connection with an alleged document leak case related to the ongoing probe against former Maharashtra Home Minister Anil Deshmukh (Anand Dilip Daga v CBI)..Single-judge Justice Yogesh Khanna issued notice to the investigating agency and posted the case for hearing next September 27, 2021.Daga contended in his plea that no written reasons or grounds were either mentioned in the arrest memo, or supplied to the petitioner at the time of his arrest, a clear violation of Section 50 of the Code of Criminal Procedure (CrPC).Moreover, the Petitioner at the time of arrest or even during the course of arguments on the application for police remand, was not provided with a copy of the first information report (FIR) which got registered on August 31, 2021 and the same got uploaded on the official website of CBI only in the evening hours of September 3, 2021.When this was brought to the notice of the special judge, the respondent claimed that on account of the sensitivity of the matter the FIR had neither been uploaded on the official website of the CBI nor provided to the accused.This, Daga claimed was in violation of the 2016 judgment of the Supreme Court of India in Youth Bar Association of India vs Union of India."The Respondent CBI therefore, has acted in complete defiance of law in the present case and had most arbitrarily and illegally taken away the liberty of the Petitioner, who is a practicing advocate at the Hon'ble Bombay High Court," the petition stated.The petitioner, therefore, sought bail claiming that his fundamental rights under Articles 21 and 22 of the Constitution have been infringed..On September 8, a Special Central Bureau of Investigation (CBI) court had dismissed the bail plea od Anand Daga and sub-inspector Abhishek Tiwari who was arrested along with Daga..Daga was represented by advocate Tanveer Ahmed Mir and his associate Advocate Kartik Venu in the matter.
