Chairman of the Bar Council of Delhi, KC Mittal has approached the Delhi High Court seeking a direction to the Central Government, Delhi Government and Delhi Police to ensure that no advocate is shunted out of their rented accommodation on failure to pay monthly rent.
KC Mittal (Petitioner) has also sought directions to all governmental and non-governmental agencies to defer recovery of all dues until restoration of normal conditions, on such terms and conditions as may be considered appropriate.
It is the Petitioner's concern that due to the total lockdown to contain the COVID-19 pandemic, people, including advocates, are not able to earn their livelihood.
Referring to the plight of advocates affected by the lockdown, the Petition reads,
Although the Bar Council of Delhi, with its minimal resources, has decided to provide some initial financial help to advocates to provide for food and medicine, if such advocates are subjected to "other recoveries", would only add "salt to wound", it is added.
The Petititioner informs that the Reserve Bank of India has already issued instructions to the Banks to defer payment of EMI for house loans.
Therefore, it is prayed that all payments due to all governmental and non-governmental agencies during this period may also be deferred to free people from tension and panic.
Such a step and directions to Central Government are essential to overcome the situation created due to spread of Coronavirus, the Petitioner asserts.
The Petition may be taken up by the Court in coming days.
