[BREAKING] Unnao accident case: Kuldeep Singh Sengar discharged by Delhi court

A Delhi court on Monday discharged expelled Uttar Pradesh MLA Kuldeep Singh Sengar in a case against him in which he was accused of masterminding a road accident in which the Unnao rape survivor who had filed rape case against him, was grievously injured [CBI v. Kuldeep Singh Sengar & Ors]..Additional Chief Metropolitan Magistrate (ACMM) Ravindra Kumar Pandey found no prima facie evidence against Sengar for the accident in which a truck had hit the vehicle carrying the Unnao rape survivor.“No prima facie evidence on record to charge Kuldeep Singh Singer regarding criminal conspiracy to extend threat to kill victim or her members. No charges can be framed against him,” the Court ruled.Principal District and Sessions Judge at the Tis Hazari Court, had earlier convicted Sengar in the Unnao rape case, in December 2019 and sentenced him to imprisonment for the remainder of his life in the rape case besides slapping a fine of ₹25 lakh on him..The accident case involving the victim took place on July 28, 2019, when a truck had rammed into the vehicle in which the rape survivor, her counsel and two aunts were travelling to Raebareli. While she and her lawyer sustained grievous injuries, her aunts were killed on the spot. The Uttar Pradesh Police filed a case of murder against Sengar and nine others in connection with the accident..The CBI investigation concluded that there was no evidence regarding criminal conspiracy hatched between those named in the FIR, including Sengar, and the truck driver or the cleaner or for that matter the owner of the offending truck..[BREAKING] No grounds to suspect "fidelity, accuracy and sincerity" of CBI investigation in Unnao accident case: Delhi court.The Tis Hazari Court had on July 31, 2021, taken cognisance of criminal intimidation and criminal conspiracy charges in the accident case and remanded the case to the Rouse Avenue Courts for further proceedings.The Court also dismissed the allegations raised by the complainant (survivor's uncle) and framed causing death by negligence, criminal conspiracy, rash driving and other charges.As the charges were triable by a Magisterial Court, the ACMM Court took up the case.When it came to passing the order on charge, the ACMM noted that the chargesheet of the case also did not mention any record or evidence with respect to the charge of criminal conspiracy among the accused persons..The discharge order further pointed out, “The accused Kuldeep Singh Sengar was in judicial custody during the period when the alleged threats were extended to the victim or her family members and admittedly the use of prosecution is that he conspired with the other accused persons to extend the threat to the victim or her family and he himself did not extend any threat.”“However, no evidence of any nature regarding criminal conspiracy apart from oral statement of the complainant and his family members is produced or attached with the Court record,” the verdict underlined.The Court thus held there was no prima facie case against Sengar and five others but found a prima facie case against the driver under Sections 304-A (causing death by negligence), 338 (causing grievous hurt by act endangering life or personal safety of others) read with Section 279 (rash driving on public way) of IPC..Charge of criminal conspiracy was dropped form four others whereas they were ordered to be charged under Section 506 Part-II (if threat be to cause death or grievous hurt) read with Section 34 (common intention) of IPC..[Read Order]
